Introduction
Pur3Pod is a platform designed to foster creativity and individuality. It serves as a hub for designers, artists, and Users with unique concepts to create and print their designs on various products available on Pur3Pod.
It is imperative for all Users, including customers, browsers, and shop owners, to respect ownership rights, copyrights, and trademarks associated with the designs and content on Pur3Pod. Only individuals who have created designs themselves are authorized to upload and grant permission for others to use them. All clients, whether buyers, designers/shop owners, or browsers, are considered "Users" ("User" or "You") under these Terms and Conditions.
Designers/Shop Owners should be aware of their legal responsibilities when publishing their work to ensure compliance with laws while sharing their products on Pur3Pod.
Please carefully read these Terms and Conditions, as they constitute a binding legal agreement between you and Pur3Pod.
Our Service
Pur3Pod offers various services (the "Services") that allow you to publish, sell, discuss, and purchase your work. Additionally, you can interact with other members worldwide and benefit from Pur3Pod's facilitation of product fulfillment, including payment processing, customer services, and product delivery. We act as a Marketplace facilitating the sale of your products to customers, while you, the independent artist, share your creations with the world on Pur3Pod.
Your Content
Pur3Pod does not claim ownership of any Content submitted by a User. If you upload, download, post, email, or transmit any Content to Pur3Pod, you grant sufficient rights to Pur3Pod to use such Content without violating any of your rights.
You retain all rights to your Content and grant Pur3Pod a worldwide, non-exclusive, royalty-free license to use, reproduce, publicly display, and perform your Content in accordance with these Terms and Conditions.
By uploading your Content, you represent and warrant that you own the intellectual property rights, and your Content will not infringe on the rights of others, be unlawful, threatening, harassing, tortious, violent, harmful, pornographic, abusive, hateful, defamatory, or violate any applicable laws.
Becoming a Buyer or Seller
To become a registered member, you must set up a password-secured account (the "Account"). You are responsible for all activities under your Account and agree to notify us immediately of any security breach or unauthorized use.
You must be at least 18 years old or have parental consent to access our Site, complying with the Federal Children's Online Privacy Protection Act of 1998.
Your use of the Site with your password is your responsibility. You agree not to reveal your password to others, and if compromised, you must change it immediately.
All Users must provide accurate email addresses and legal information. Lack of this information may prevent your content from being viewed publicly and sold on our Site. False information will result in shop termination.
Payment to Users
As a seller, you charge customers for each Content you sell. The product price includes Pur3Pod's base price, design fees, and your Commission. Pur3Pod facilitates payment processing, and your payment will be made quarterly within 45 days of the end of a calendar quarter. The minimum commission payout is $50.00.
It is your responsibility to provide accurate payment details, and you are accountable for incorrect details.
Taxes
You are responsible for handling all applicable taxes related to transactions. Reporting obligations to relevant tax authorities are entirely your responsibility.
Duplicate payment accounts for designers are not allowed, and Pur3Pod may delete duplicate accounts for organizational purposes.
Standard Terms for Purchasing/Returning a Product on Pur3Pod
Orders placed on Pur3Pod serve as a binding offer, and the contract becomes active upon Pur3Pod shipping the ordered product. Pur3Pod reserves the right to deny orders or cancel them if they violate these Terms and Conditions or infringe on the rights of any person or law.
Buyers can purchase products using credit cards, PayPal, or Apple Pay. The cost is fixed at the time of ordering, and the buyer is responsible for providing the correct delivery address.
Cancellation before printing incurs a 15% fee, and orders cannot be canceled once printing begins. Buyers have 30 days after shipment for a refund or exchange. Pur3Pod addresses issues with incorrect orders or damaged products.
Addressing and Reporting Inappropriate Content
While Pur3Pod does not regularly review posted content, it has the right to remove or edit inappropriate content. Users can report inappropriate content, and Pur3Pod may remove or edit it as deemed necessary.
Rules and Warnings to All Users
All Users must confirm that using the Site and Services is legal. Users must be at least 18 years old or have parental consent to access the Site.
Users must take precautions to protect their computer systems from viruses and other interference during site access.
Pur3Pod is not responsible for any losses resulting from the failure to supply the Pur3Pod Service, errors, loss of data, interruptions, or violations of obligations under these Terms and Conditions.
Pur3Pod cannot verify the identity of registered members and is not responsible for their actions.
Intellectual Property Rights
All intellectual property rights in the Site and Services are owned by or licensed to Pur3Pod. Users cannot use any Pur3Pod Content without written permission.
Pur3Pod respects intellectual property rights and removes infringing content upon notice.
Disclaimer of Warranties
Pur3Pod Service is provided on an "as is" and "as available" basis. Pur3Pod does not guarantee error-free, virus-free services, and users must take precautions against viruses.
Liability
Pur3Pod does not accept responsibility for defective services or any loss or damage directly or indirectly connected to Site use.
Pur3Pod is not liable for indirect, incidental, special, or consequential damages resulting from the use of the Service.
Indemnity
Users indemnify Pur3Pod and its affiliates against any claims arising from breaches of these Terms and Conditions or misuse of the Site.
Governing Law
These Terms and Conditions are governed by the laws of the State of California. Disputes will be submitted to the jurisdiction of state and federal courts within Orange County, California.
